This website is owned and operated by Evie Group Pty Ltd. By accessing or using this website you agree to the following terms and conditions of use for any services, information and products available from this site.

Information provided is for general informative purposes only. This should not be substituted for legal advice. These terms are subject to change without prior notice. Should any part of the Terms and Conditions, Online Purchases or Privacy Policy change, this will be posted here.

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions without prior notice. We accept no liability, including loss or damage that you or a third party may incur from the use of this site or from a third party interception of this site. Evie Group reserve the right to modify the information provided on this site at any time to improve its function or as required by law.

This statement only addresses activities from Evie Group. Any site or third party linked to the site/services may have their own separate policies, independent from Evie Group. Evie Group therefore has no responsibility or liability for these independent policies. Evie Group is not responsible for any links clicked on that direct you away from our site or their privacy practices. We encourage you to read their privacy statements.

Our website uses Google Analytics to gather anonymous information about the use of the site. This data, such as number/frequency of visits and pages viewed, is only used to improve the function of the site. It will not be published for other use.

Evie Group endeavours to protect your privacy. Your information you have chosen to provide will not be used for any other purpose that you have subscribed to without your consent or disclosed to third parties. Information is requested to assist in processing sales orders and delivery to you, the customer. Personal information collected includes name, phone number, email address and shipping address in order to complete the service effectively and make this more valuable to you. We do not pass these onto third parties with exception for delivery purposes requirements.

As payment methods are conducted through PayPal, we do ask for your credit card or banking details. Should you wish to pay by credit card over the phone or by email, Evie Group will use these details in strict confidence and delete all card records after the sales order has been processed.

Evie Group has a mailing list which you can choose to opt into. Your data is not automatically added to this subscription. In doing so, personal information such as your name and email address is requested. There are 3-10 newsletters a year, on new products and news of the Evie Group. We will not spam your email or pass your details on to third parties. You have the option to unsubscribe at any time should you no longer wish to receive this newsletter. We do not have access to your personal information unless disclosed by you. You are solely responsible for any disclosure of personal information on the internet and email. Please act responsibly and carefully.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

Information and design of this site is protected by Australian Copyright Law. Any reproduction of the site, appearance and content may be seen as an infringement of intellectual property law and is prohibited.

Evie Group grants access to use the website for personal and non-commercial use (other than purchases made through the online store). Any other use of this information is unauthorised. You may not reproduce, publish, distribute, modify, plagiarise or create copies of any works or content in part of in entirety. Should you wish to use any content from the site, please contact Evie Group for permission.

Product description and representation
Each design is represented as accurately as possible through imagery and descriptions. Colours and finishes may vary in the physical product from images viewed online, through your monitor or device. Slight variations in finishes may also occur through product development, manufacture and technology improvements in production cycles over time which we cannot control. Thus, we reserve the right to amend the specifications of products, their price, packaging and any service associated at any time, without prior notice.

Stock availability and spare parts
All items are subject to availability. Our website is generally kept up to date with items in stock or lead times advised. Should any online purchases be made when an item is not in stock, we will contact you immediately. To ensure items are in stock before placing orders, please contact us.

Lead times may vary for custom made pieces which are not held in stock. You will be notified should this be the case. Evie Group are not responsible for extended lead times or any inconvenience this may cause.

Evie Group will carry spare parts for products for 2 years from the initial production date. We cannot guarantee the availability of spare parts outside this period. Where a Product is outside of warranty, Evie Group reserves the right to refuse to supply spare parts where limited stock is available.

Product pricing
All prices displayed on this site are in Australia Dollars (AUD). Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Product at any time without notice. Prices for items in an order are fixed once your order has been confirmed. Subsequent price changes will not be applied to confirmed orders. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Product.


Orders and custom products
For all custom made orders and items not in stock, we require a 50% deposit to confirm your order. Confirmation of order is from receipt of the deposit.

Online purchases
Customers should clearly understand the terms and conditions before purchasing online. Please read the following policy regarding purchases, returns and exchanges. Should you have any questions, please contact us.

Your online purchase is accepted with a return email confirmation containing a copy of your order. It is the customers’ responsibility to ensure correct details are entered at time of purchase including name, shipping address, phone number and email to ensure delivery of your products. Evie Group will not be responsible for missed delivery or loss of products for incorrect information submitted at time of purchase. Evie Group is also not to be held liable for any losses indirect or consequential of the customer.

Purchases from Evie Group are for personal use only and are not permitted for on-sell or resale.
Evie Group reserves the right to cancel your order prior to payment being processed and can choose to refund orders which cannot be fulfilled.

Payment
Purchases through the online store are conducted through Shopify & PayPal, offering you a secure payment method. You can view their privacy policy here:

Evie Group does not have access to your banking or credit card details. When making an online purchase, you agree to purchase the product/s at the stated price as well the added shipping charges as shown on checkout. All prices are listed in Australian Dollars (AUD) and include GST for Australian customers. (International orders are exempt from GST and this is calculated in the final sales price with shipping).

Receipt of purchase will be emailed to your nominated email account. A tax invoice from Evie Group will be delivered with the goods. Evie Group does not take any responsibility for other parties using your accounts. It is the responsibility of the user (you) to keep these details confidential.
We also accept the following payment methods: electronic transfer via direct deposit, Visa and MasterCard. Please note there is a 2.5% surcharge for all Visa and MasterCard payments processed over $1000AUD. Please contact us directly to pay via these methods.

Returns & Exchanges
Evie Group offer a 14 day exchange or return policy from your date of purchase. Items can be exchanged for other pieces from the Evie Collection or an Evie store credit outlined in these conditions below. We do not offer refunds for change of mind.

In the event you wish to change your items, Evie Group must be notified in writing of the intent to exchange/return goods. All returns or exchanges must be made within 14 days from the purchase date. Invoice number/proof of purchase and reason/s for the exchange must be made clear. Evie Group will advise on stock availability at that time for exchange.

Items for exchange will only be accepted if they are unused, undamaged, unmarked, in saleable condition and in their original packaging. The original cost of shipping goods to you will not be reimbursed.

The cost of returning goods is the responsibly of the customer (you). Goods must be returned within 14 days of the original purchase date. Evie Group is not responsible for goods returned damaged, marked, not in saleable condition and not in their original packaging. If this occurs, a full or partial refund/exchange will not be honoured. The customer must comply with Evie Group to facilitate the return. All communication will be via email to info@eviegroup.com

Replacement goods will be dispatched once the original goods have been received by Evie Group. Evie Group is only responsible for return delivery fee should items be deemed faulty. At all other times, the cost for re-delivery is the responsibility of the customer (you). We recommend returned items be sent using a trackable service with signature on delivery, we are not responsible for items lost in transit.

Items abused, not used in the intended manner, altered in any form or not cared for as per recommended care and maintenance provided with the products, are not subject to replacement or covered under each product's individual warranty.

Orders cancelled after the product(s) have been dispatched will be treated as per the terms of our 14 day Return/Exchange policy and the cost of shipping will not be reimbursed.

Faulty Items
Should you consider an item faulty or damaged on its arrival, please contact Evie Group immediately to discuss. Faulty items are at the discretion of Evie Group.

Where products have been damaged on delivery receipt, Evie Group requires photographic evidence of damage to be emailed to info@eviegroup.com to facilitate the return process. Please note this should be as the delivery is made and within 14 days or product purchase.

Where a replacement product is not available, Evie Group can provide a partial or full credit note value subject to the value of product damage. Credit notes exclude delivery costs.

Sale, clearance & discontinued items
Evie Group does not offer exchanges or returns on sale or clearance items. Products are purchased ‘as is’ and are void of any individual product warranties.

Shipping & Delivery
Evie products are packed carefully by Evie Group to ensure they reach you in pristine condition. Any potential damage on arrival should be addressed with Evie Group on receipt of goods. The risk and title of the goods are assigned to you on delivery.

All items are dispatched from Sydney, Australia within 1-3 business days from orders processed. Goods are dispatched to the nominated delivery address placed in your order. Any delivery instructions should be addressed at the time of placing the order, before goods have been dispatched as this cannot occur once in transit. Any redirection, loss of items or missed delivery as a result of incorrect information supplied on purchase is at cost to you, the customer.

Shipping rates are calculated by weight, size and value of the goods. The cost of shipping is indicated at the checkout. You agree to pay delivery charges as they are calculated and listed in the order confirmation at the time of purchase. Goods are insured to ensure these reach you without damage. A signature may be required on receipt of delivery. Evie Group is not responsible for any additional charges should a parcel need to be re-delivered. This is the responsibility of the customer (you).

For larger/bulky items, such as furniture and lighting, delivery method will be discussed with the purchaser (you) to arrange suitable delivery method, depending on your location and site access.
Evie Group acts to ensure that all products are delivered in a prompt and timely manner. There may be instances outside our control where shipments are delayed. Evie Group does not accept any liability for loss or damage caused to or suffered by anyone as a result of any such delays.

Should you select the courier option with authority to leave goods, please ensure instructions are clear and items can be left in a safe place. Evie Group takes no responsibility for items selected with authority to leave. All rights are handed over to the purchaser on dispatch of goods.

Australia
Delivery within Australia is made via Australia Post or our preferred courier services.
Shipping is approximately 3-7 working days within Australia. Non-metropolitan areas and deliveries to WA, TAS & NT may require additional day/s for delivery. Deliveries are only conducted on weekdays (Monday to Friday).’

Once goods are in transit, these cannot be recovered. Evie Group is not responsible for any incorrect information given on placement of order. Any fees encountered for missed delivery, loss of goods or redirection of shipment is at cost to the purchaser.

International orders & delivery
International purchases are charged in Australian Dollars without GST. Lead time and costs of shipping to your nominated international address will be quoted upon order placement/enquiry if not made direct through the online store. International shipping rates are calculated by volumetric weight. Some international shipments may be subject to import duties, customs and taxes. Any of these additional costs are the responsibility of the purchaser (you). Your local customs office will be able to provide this information to you. Insurance is available for international shipping at the customer’s request.

International orders are dispatched within 1-3 business days from receipt of payment to allow for packing, processing and collection of goods.

All small orders are shipped via Australia Post air freight with 10-14 business days delivery to metro areas (longer lead times in non-metropole areas and peak seasons). Tracking number will be provided to you on shipment of the goods.

Bulk orders are shipped via DHL express and a tracking number and confirmation will be emailed to you on dispatch of the goods.

Once goods are in transit, these cannot be recovered. Evie Group is not responsible for any incorrect information given on placement of order. Any fees encountered for missed delivery, loss of goods or redirection of shipment is at cost to the purchaser.

Cancellation of order
Cancellation of orders should be made within 24 hours of order confirmation online. A later cancellation may not be possible, since we endeavor to ship the goods immediately.
We reserve the right to limit or prohibit sales or quantity of products sold to any person or geographical location.

Governing Law
These Terms and Conditions will be governed by and interpreted in accordance with the laws of New South Wales, Australia and you irrevocably submit to the non-exclusive jurisdiction of the Courts of that State and Country. If any provision of these terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of these Terms and Conditions, which will continue in full force and effect.

You agree that you will not engage in any activity that interferes with or disrupts this website, the servers and networks that host it or disable the security features on this website. Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities.

Indemnification
You agree to defend, indemnify and hold Evie Group and our partners, employees, suppliers and subcontractors harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site or breech of the outlined Terms and Conditions.
